What Happens When You Don’t File Your Tax Return?
You might think that as long as you don't hand the IRS a tax return, they can't possibly know what you owe. In reality, the exact opposite is true. If you haven't filed in years, you aren't invisible to the government; you are simply letting them write your financial story for you. When you don't file, the IRS eventually loses patience and creates what is called a Substitute for Return (SFR).
Imagine walking into a restaurant, refusing to look at the menu, and telling the waiter to just bring you whatever they want and send the bill to your house. That is essentially what happens with an SFR. The IRS uses the income information they have on file from your employers and banks, but they don't look for your deductions. They won't hunt for your business expenses, your charitable donations, or your credits. They calculate the highest possible tax bill using a single or married-filing-separately status and then send you the invoice.
By the time you receive that bill, the number is already inflated. On top of the tax they think you owe, the IRS adds a failure-to-file penalty, which starts at 5% of the unpaid taxes for each month or part of a month that a tax return is late. This penalty caps out at 25%, but when you add the failure-to-pay penalty and compounding interest, that original debt can easily double before you even open the envelope.
Ignoring the mail won't stop the clock. Once that tax is assessed—whether you filed the return or they did—the IRS has ten years to collect it. They can garnish your wages, seize the funds in your bank account, or place a lien on your home, which effectively freezes your ability to sell or refinance your property. Perhaps most frighteningly, if the IRS creates the return for you, that debt is generally not dischargeable in bankruptcy. You lose one of the most powerful tools for a financial fresh start simply by staying silent.
There is good news, however. Even if the IRS has already filed a return for you, you have the right to file your own original return to correct the record and claim the expenses you actually had. You don't have to accept their version of your life.
